2.1 By using the Website and other services provided De Goudhandel and JEWELRY TRADING LLC, such as placing purchase orders (see Article 5), sale orders (see Article 20), or keeping products in the vaults of De Goudhandel and JEWELRY TRADING LLC, the customer consents to be bound by these general terms and conditions. Unless specifically approved in writing by De Goudhandel and JEWELRY TRADING LLC, any written documents or special conditions submitted by the customer that differ from our conflict with these general terms and conditions will not supersede them. Regardless of whether transactions are carried out over the phone, online, or through another channel, these terms apply to all orders, sales, purchases, and product storage.
2.2 When opening an account, placing a purchase order, placing a sale order with De Goudhandel and JEWELRY TRADING LLC, or storing products in the vaults of De Goudhandel and JEWELRY TRADING LLC, the customer certifies that they are at least eighteen years old, free from any kind of curatorship, and capable of making decisions De Goudhandel and JEWELRY TRADING LLC permits each customer to open a single (1) account under their own name or any other name.
3.1 De Goudhandel and JEWELRY TRADING LLC 's product(s) prices are contingent upon the state of the financial markets.
3.2 Every investment carries some degree of risk. The customer should evaluate the state of the market and seek advice from their financial advisor if they are thinking about investing in precious metals. The client acknowledges that De Goudhandel and JEWELRY TRADING LLC does not offer any guidance regarding the possibility of making an investment in, withdrawing an investment from, or holding onto a specific precious metal.
3.3 Furthermore, the customer acknowledges that any order placed on this website or transaction with De Goudhandel and JEWELRY TRADING LLC is made at his or her own risk.
4.1 The pictures, videos, and descriptions of the products, as well as the condition of the stocks mentioned on the website, are not contractual and are merely informational, even though De Goudhandel and JEWELRY TRADING LLC aims to provide customers with the most thorough and thorough information possible.
4.2 The website displays prices that are expressed in US dollars and AED (United Arab Emirates). They don't include shipping fees, taxes, or other expenses.
4.3 Shipping costs are computed and paid for each order, unless it is technically impossible to combine several orders into one. The metal value at the time of delivery is requested.
4.4 Without limiting any of the aforementioned, the customer agrees that De Goudhandel and JEWELRY TRADING LLC 's products and services, as well as their information, pricing, data, and availability, are subject to human, mechanical, typographic, or other errors, oversights, limitations, delays, and service interruptions at any time and from time to time. (I) This includes, without limitation, any errors that may be entirely or partially related to, arising out of, or resulting from De Goudhandel and JEWELRY TRADING LLC 's or its suppliers' computer hardware and software. Databases, business processes and procedures, telecommunication and operating systems, and other issues that are inherent in or may be related to the use of the internet and electronic communications, such as, but not limited to, significant events, government regulations, and third-party acts and omissions that affect or impact De Goudhandel and JEWELRY TRADING LLC 's information and services, as well as its products and services.
4.5 The sole and exclusive ownership of all copyrights, trademarks, and other intellectual property rights on the De Goudhandel and JEWELRY TRADING LLC website, as well as any webpages, documents, advertising, or other supporting materials, shall always belong to De Goudhandel and JEWELRY TRADING LLC or its third-party owners. Unless De Goudhandel and JEWELRY TRADING LLC specifically agrees, the Customer will not have any rights or interests in such intellectual property rights other than the non-exclusive right to access and use them as permitted by or create derivative works of De Goudhandel and JEWELRY TRADING LLC's intellectual property rights or how they operate.
5.1 The products displayed on the website by De Goudhandel and JEWELRY TRADING LLC do not constitute a binding offer, but rather an invitation to the customer to engage with them.
5.2 By clicking on the 'Confirm Order' button, the customer is making a legally binding offer to purchase the Product(s) involved. The customer will the receive an Automated Order Confirmation from De Goudhandel and JEWELRY TRADING LLC.
5.3 Before clicking on the “CONFIRM ORDER” button, the customer can view and modify his/her order directly in his/her cart.
5.4 The Order Confirmation serves as the acceptance of the Order by De Goudhandel and JEWELRY TRADING LLC, thereby establishing a binding contract between De Goudhandel and JEWELRY TRADING LLC and the Customer.
5.6 The sale conducted by De Goudhandel and JEWELRY TRADING LLC, along with the shipping or storage of the Product, is explicitly contingent upon De Goudhandel and JEWELRY TRADING LLC receiving the complete payment of the total order price.
5. De Goudhandel and JEWELRY TRADING LLC retains the authority to refuse, cancel, and terminate any Order/Contract at any time prior to delivery, exercising its sole reasonable discretion (primarily, but not exclusively, in cases of partial or complete non-payment by the customer) without incurring any liability to the Customer.
5.8 Cancellation of Order(s) by De Goudhandel and JEWELRY TRADING LLC is subject to De Goudhandel and JEWELRY TRADING LLC’s market loss policy (refer to article 12).
5.9 Important Notice: A default by the Customer regarding the payment of his/her Order(s)/Product(s) will be governed by De Goudhandel and JEWELRY TRADING LLC’s market loss policy (see Article 12).
5.10 Discounts can only be applied during the ordering process on the website. Each discount is associated with a specific discount code and comes with various requirements and benefits. All conditions outlined in the discount code must be fulfilled to obtain the discount, and each code is only valid for a limited duration. A discount code may be used only once. Discount codes are non-transferable, cannot be exchanged for cash, and cannot be combined with other coupons or offers. Only one discount code is permitted per order. De Goudhandel and JEWELRY TRADING LLC reserves the right to terminate any discount code at its discretion.
6.1 De Goudhandel and JEWELRY TRADING LLC presently accepts payments for orders exclusively in UAE Dirhams (AED). Customers have the option to pay through bank transfer or Apple Pay.
6.2 Upon placing an order, the customer will receive an invoice from De Goudhandel and JEWELRY TRADING LLC indicating the total amount paid for the order.
7.1 All items dispatched by De Goudhandel and JEWELRY TRADING LLC are covered by insurance throughout the shipping process. The responsibility shifts to the Customer once the delivery is considered finalized.
7.2 All items are dispatched De Goudhandel and JEWELRY TRADING LLC at its discretion through a recognized carrier, Valuables Transport Services LLC.
7.3 Items purchased through an Auto savings plan are intended solely for storage and are not eligible for shipping.
7.4 In the event the Customer selects the: Shipping” option, delivery of the Product shall occur at the agreed upon address.
7.5 The delivery will be considered complete once the products are handed over at the specified address or pickup location to an individual who claims or appears to be authorized. This individual may be required to verify their identity. Deliveries to mailboxes, deposit boxes, etc. are prohibited and will not be covered by insurance.
7.6 If, for any reason outside of our control, De Goudhandel and JEWELRY TRADING LLC is unable to deliver the Product, it may terminate the contract. In accordance with De Goudhandel and JEWELRY TRADING LLC’s market loss policy (refer to article 12), any payments made will be refunded to the customer. The rights of De Goudhandel and JEWELRY TRADING LLC, especially regarding any offsets for extra expenses, will remain intact.
7.7 The costs associated with transport/shipping, taxes, and risks related to the return of the Product (including situations where the carrier fails to leave a calling card) due to reasons attributable to the Customer (such as unclaimed Products, incorrect or incomplete delivery addresses, etc.) and/or potential re-shipment are solely the responsibility of the Customer. This also includes the risks associated with storing returned merchandise.
7.8 De Goudhandel and JEWELRY TRADING LLC will not proceed with reshipping any order until it has received full payment for any return shipping costs, duties, and taxes that it has incurred or advanced on behalf of the customer, along with any additional fees required to send the product back to the Customer.
7.9 For insurance reasons, the delivery of Products with a total value exceeding five hundred thousand Dirhams (AED 500,000.00), particularly if the Order includes individual items valued over AED 250,000.00, will be divided into multiple packages. In such cases, De Goudhandel and JEWELRY TRADING LLC will utilize a specialized shipping service.
7.10 The Customer may incur taxes and/or duties related to their delivery Order of Products from De Goudhandel and JEWELRY TRADING LLC.
7.11 The Customer is advised to check with their local customs office for detailed information regarding duty and tax rates De Goudhandel and JEWELRY TRADING LLC consistently declares the complete value of the shipment on all customs documentation. This policy is strictly enforced without exceptions.
7.12 The Customer is responsible for paying all duties and taxes by the time of Product delivery at the latest. De Goudhandel and JEWELRY TRADING LLC will not assume responsibility for any duties and/or taxes that fall solely under the Customer's obligation.
7.13 Important Notice: The Customer must decline any shipment that seems damaged or has been tampered with, as shipping insurance ceases once delivery is considered complete. If a shipment is refused, the package(s) will be sent back to De Goudhandel and JEWELRY TRADING LLC for examination. Customers are required to promptly file a complaint via email to De Goudhandel and JEWELRY TRADING LLC customer service to maintain any rights related to the shipper/carrier. In case of a loss, the Customer must notify De Goudhandel and JEWELRY TRADING LLC within two (2) business days from the last recorded scan of the package. Reports of loss submitted after this period will regrettably be denied.
7.14 In the event of any disruption in the delivery of Product(s), the Customer agrees to assist De Goudhandel and JEWELRY TRADING LLC in any investigation or claims process and to undertake all reasonable actions requested during this process. A lack of full cooperation may jeopardize any coverage that could be available to the Customer.
8.1 De Goudhandel and JEWELRY TRADING LLC ensures that the Customer's Product(s) are securely stored in dedicated and separate vaults owned by De Goudhandel and JEWELRY TRADING LLC. The Customer maintains full ownership of their Products stored with De Goudhandel and JEWELRY TRADING LLC.
8.2 De Goudhandel and JEWELRY TRADING LLC operates as a private entity, with all assets held outside the banking system. When stored in secure facilities managed by De Goudhandel and JEWELRY TRADING LLC 's service provider, Product(s) are insured according to current market values and safeguarded against physical loss, theft, and/or damage.
8.3 The Customer can request the delivery of their Product or sell all or part of their Product to De Goudhandel and JEWELRY TRADING LLC at any time through their personal online account. The Customer has online access to their account, which displays the status of their Product.
8.4 If the Customer wishes to ship Product(s) stored in Storage, they will be responsible for the applicable shipping costs. All expenses related to the shipping of the stored Products, including duties and/or taxes, are solely the responsibility of the Customer.
8.5 Products purchased and stored with De Goudhandel and JEWELRY TRADING LLC are exempt from VAT.
8.6 De Goudhandel and JEWELRY TRADING LLC will not deliver stored Product(s) to the Customer until the shipping costs have been received
8.7 Important Notice: A Customer account will be deemed inactive if there are no login attempts from the Customer for a duration exceeding one (1) year since the last login. This is applicable after De Goudhandel and JEWELRY TRADING LLC has made clear and significant attempts to contact the Customer and/or Person of Contact without success. In cases where a customer account with existing Stored Product(s) becomes inactive, De Goudhandel and JEWELRY TRADING LLC retains the right to sell the Product(s), imposing administrative fees of one thousand three hundred UAE Dirhams (AED 1300.00), at the Customer's risk. The Customer and/or Person of Contact may request reimbursement of the net proceeds from the sale within 360 days of the transaction. De Goudhandel and JEWELRY TRADING LLC 's rights, including any offset rights, remain intact.
9.1 When purchasing from De Goudhandel and JEWELRY TRADING LLC, a binding contract is established for the Customer once an Order Confirmation number has been issued by De Goudhandel and JEWELRY TRADING LLC. Consequently, the transaction price is secured, and any associated market risk is transferred to the Customer.
9.2 Should there be a default in payment for Products, either partially or fully, De Goudhandel and JEWELRY TRADING LLC reserves the right to retain or claim the positive difference in the Product's price from the day the Order is made to the day payment is due.
9.3 If the Customer cancels an Order for reasons not attributable to De Goudhandel and JEWELRY TRADING LLC, this will be subject to De Goudhandel and JEWELRY TRADING LLC 's market loss policy (refer to Articles 9.1 and 9.2) along with a cancellation fee of TWO HUNDRED UAE Dirhams (AED 200.00).
9.4 The Customer is also responsible for covering all fees and costs incurred by De Goudhandel and JEWELRY TRADING LLC in their attempts to collect any outstanding amounts owed by the Customer.
9.5 No future Orders or fund withdrawals via De Goudhandel and JEWELRY TRADING LLC Pay by the Customer will be allowed until the market loss has been fully settled. The rights of De Goudhandel & JEWELLERY LLC, particularly any offset rights, remain intact.
10. Product Faults and Liability for Loss or Damage
10.1 If defects are not visible at the time of delivery upon signature, the Customer is required to inform Customer Service within three (3) Working Days from the date of receiving the Product(s). Failing to do so will result in the defect of being deemed accepted.
10.2 In cases where multiple Products are purchased, the defective status of one Product, its replacement, or the inability to ship that Product will not nullify the entire purchase agreement.
10.3 After a claim is submitted and the defect is acknowledged De Goudhandel and JEWELRY TRADING LLC, the company reserves the right to either re-ship the items at its own expense or issue a refund to the Customer at its discretion. De Goudhandel and JEWELRY TRADING LLC will not have any further obligations or liabilities to the Customer.
10.4 Upon the Customer's request, De Goudhandel and JEWELRY TRADING LLC may, but is not required to, offer the Customer the chance to exchange a Product for an identical one in the case of a material defect. The Customer must obtain written confirmation that the exchange request has been approved.
11. Standards for Anti-Money Laundering and Terrorism Financing
11.1 The management of De Goudhandel and JEWELRY TRADING LLC prioritizes adherence to stringent anti-money laundering standards and the prevention of terrorism financing activities.
11.2 De Goudhandel and JEWELRY TRADING LLC diligently enforces the following regulations aimed at preventing money laundering in the UAE: • UAE Articles (2) and (3) of Cabinet Decision No. (10) of 2019 Regarding the Implementing Regulation of Decree Law No. (20) of 2018 on Anti-Money Laundering and Combating the Financing of Terrorism and Illegal Organizations. Federal Act on Combating Money Laundering (AML) • Anti-Money Laundering Ordinance (AMLO) • Ordinance on Combating Money Laundering and Terrorist Financing in Banking Precious Metals Trading (FOCBS-AMLO)
11.3 To achieve the aforementioned objectives, the Customer is required to provide and disclose to De Goudhandel & JEWELLERY LLC the personal information necessary for identification if they wish to establish, maintain, or execute a business relationship or specific transaction. As a contractual partner of De Goudhandel & JEWELLERY LLC, the Customer is legally obligated to cooperate with the company. When required, the Customer must furnish De Goudhandel & JEWELLERY LLC with the information and documentation essential for identification. Any changes in the Customer's personal circumstances must be reported to De Goudhandel & JEWELLERY LLC promptly. In all instances, De Goudhandel and JEWELRY TRADING LLC mandates the Customer's name, first name, address, nationality, date of birth, and verification of the email address. De Goudhandel and JEWELRY TRADING LLC consistently ensures that the contracting partner's name aligns with the information provided and the credit card/bank payment details.
12. Return Policy
Following delivery, returns or exchanges will not be permitted unless explicitly authorized in writing by De Goudhandel and JEWELRY TRADING LLC. If De Goudhandel and JEWELRY TRADING LLC consents to a return or exchange, it must be finalized within two (2) Working Days from the date the Customer receives confirmation of the return's acceptance. Beyond this timeframe, the return will be automatically declined. The return should utilize the original packaging and require a signature upon delivery. The Customer bears the risk of loss during the return shipment and is responsible for all costs related to the return.
13. Contact and Updates
13.1 The Customer agrees to inform De Goudhandel and JEWELRY TRADING LLC of any updates regarding their name, address, email address, and banking information.
13.2 Any notification or communication will be considered received at the moment of delivery or transmission, if sent via email, registered mail, or courier, to the most recent physical or email address provided by the Customer.
14. Inheritance Procedures
In matters of succession, De Goudhandel and JEWELRY TRADING LLC exclusively adheres to UAE law to verify the validity of the documents. Should De Goudhandel and JEWELRY TRADING LLC find the documents inadequate, the Customer will bear the costs of obtaining any additional documents. Furthermore, an administrative fee of AED900 per hour (nine hundred AED per hour) may be imposed on the Customer to cover extra compliance expenses or inheritance processes.
15. Complete Contract
15.1 These General Terms and Conditions (GTC) represent the entire and complete agreement between De Goudhandel and JEWELRY TRADING LLC and the Customer. They replace any previous proposals, communications, or other documents concerning the subject of these GTC, unless modifications have been mutually accepted in writing by both parties.
15.2 In the event of any inconsistencies between the English version of the GTC and any translated versions provided on the Website, the English version will prevail.
16. Effectiveness and Amendments
16.1 If any section of this agreement is deemed legally invalid, it will not impact the validity of the other provisions. Instead, the invalid section will be substituted with a valid one that closely aligns with its intended economic purpose. This principle also extends to any omissions present in this agreement.
16.2 De Goudhandel and JEWELRY TRADING LLC retains the right to modify these General Terms and Conditions (GTC) at any time. Any updates will be posted on this page, which will be updated accordingly. It is the Customer's duty to periodically check this page to remain informed of any changes.
17. Privacy and Data Security
17.1 In order to utilize the services of De Goudhandel and JEWELRY TRADING LLC and to place orders via the Website, the Customer is required to create an account, which they can modify or remove at any time. Should the Customer decide to delete their account, De Goudhandel will keep an anonymized version of the data for legal purposes. It is essential to provide accurate personal information; without it, De Goudhandel will be unable to process orders or transactions.
17.2 All personal information shared on the Website (such as addresses and purchase history) is treated with the utmost confidentiality.
17.3 Customers have the ability to change or delete their personal information, including addresses and purchase history, by navigating to the "Profile" and "Address" sections on the Website.
17.4 De Goudhandel does not retain credit card information; transactions are securely processed by payment partners. Bank details provided for wire transfers and fund withdrawals are securely stored by De Goudhandel and are used solely for those purposes.
17.5 The Website and App utilize persistent cookies to monitor transactions and enhance future visits. Customers can adjust cookie settings through their web browser's security preferences.
17.6 De Goudhandel employs anonymous data gathered through Google Analytics to assess Website usage and enhance its structure based on customer requirements.
17.7 De Goudhandel does not disclose customer data except to service providers who assist in executing online sales or conducting statistical analyses. These service providers only have access to the data necessary for their functions and are obligated to adhere to data protection laws.
18. Regulating Law and Dispute Resolution
18.1 These General Terms and Conditions (GTC) and all transactions carried out with De Goudhandel are governed by and interpreted in accordance with UAE law, excluding any conflict of laws principles that would apply to other legal systems.
18.2 Any disputes arising from or related to the relationship or transactions between De Goudhandel and the Customer shall be subject to the exclusive jurisdiction of the courts in the Canton of Dubai.
